As this topic is broader that just EOS I think it is proper to start new topic specifically about the technate and it's legal status.

We should start with realisation that the most of the problems with understanding comes from the fact that the Technate's functional structure and legal structure is somehow different. This is the result of the fact that we try to create something new without anchoring it first in the existing system. As a result there is a big problem with understanding what we try to accomplish as there is no point of reference.

In my opinion, registering technate as a legal entity and writing by-laws could easily provide this framework and help people to understand what we try to accomplish. As we disscussed on Skype, the Technate Board would have minimal authority and we can imagine them being the "signing pens" of the Technate, realizing the directions of the General Assembly (I will use this term for the cross-organizational, technate's decission making body). However, I am all for the maximum decentralization and we can write by-laws limiting the Board competencies to simply accepting new organizations, representation (media) and signing contracts (if neccessary). Again, the main focus is on participating organizations, Board would be almost purerly representative body for the purposes of promotion.

Technate NGO
- Technate NGO is the "glue" providing legal framework for the entire legal structure
- Participating organizations sign agreement with Technate NGO, which regulates relations, responsibilities and procedures
- Technate NGO provides the legal status for the projects and groups not having (or willing to have) one

The Board
- is the "signing body" of the Technate NGO. Functions: representation, control, realisation of the General Assembly directions.
- sorting out the legal issues and providing the legal framework

General Assembly
- decission making body, if the Technate as a whole needs to take one (kinda Technate's Parliment)
- again, the by-laws should be written in a way that this GA is only summoned in the case of emergency. Everyday operations should be conducted on the operational level by the autonomous holons.

Summing up:
I strongly believe that the legal framework is necessary as we need both - clear rules and some form of protection as well. At the same time I totally agree that it should be a network of the independent and autonomous organizations (holons).

I agree that I think the technate should be a registered organisation. The main issue for me is to install procedures based on the constitution which could prevent the technate from becoming too rigid, centralised and controlling. All movements within the technate should keep as much of their own identity and their own autonomy as they wish, as long as these aspects are not in conflict with the core goals and values of the constitution.
